NewsEchr is committed to safeguarding the privacy of the users of www.NewsEchr.com. This Privacy Policy statement explains the data processing practices of NewsEchr.

PRIVACY NOTICE

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC – GDPR, regulates all important aspects of the data processing activities of the Data Controllers and Data Processors in EU, as well as for data processing activities of the Data Controllers and Data Processors in non-EU countries when the data processing operations are related to:
  • The offering of goods or services to the data subjects in EU, irrespective of whether a payment of the data subject is required (e.g. e-commerce services, tourist services etc.);
  • The monitoring of behaviour of data subjects in EU as far as their behaviour takes place within the Union.
NewsEchr collects, processes and uses the particular data from the data subjects, as Data Controller within the meaning of the Article 4 Paragraph 1 Point 7 of the GDPR, in order to send them the media content produced by NewsEchr and its affiliates and transfer organizations. Although the entity that falls under the scope of local data protection regulatory framework, the NewsEchr is fully dedicated to ensure the highest level of protection of the personal data, and therefore it shall be complaint with the GDPR requirements.
  1. TYPE OF PERSONAL DATA THAT ARE PROCESSING

  2. NewsEchr collect, use and in other manner process the following personal data of the data subjects:
    • name and family name;
    • e-mail of the data subject;
    • user name and password of the data subject.
  3. LEGAL BASIS OF DATA PROCESSING AND PURPOSE OF PROCESSING

  4. Legal basis for the processing of the above mentioned data is the performance of a contract to which the data subject is party, pursuant to the Article 6 Paragraph 1 Point b) of GDPR. NewsEchr  collect, use and process the personal data of the data subject exclusively for the purpose of sending of the Newsletter, and other media content produced by NewsEchr  or its affiliates and partners.
  5. DATA PROCESSING ACTIVITIES

NewsEchr performs the following data processing activities: collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available to the authorized persons, alignment or combination, restriction, erasure or destruction, other processing activities which are necessary for the purpose defined in Point 2 of this Privacy Notice.
  7. CATEGORIES OF SUBJECTS THAT HAS ACCESS TO THE PERSONAL DATA

  8. Beside NewsEchr, the following categories of subjects have access to personal data:
    • NewsEchr affiliates;
    • NewsEchr partners;
    • Companies that install and maintain the ICT system of NewsEchr;
    • Companies that perform the security services to NewsEchr ;
    • Other companies that fall under category of the Data Processor within the meaning of the Article 4 Paragraph 1 Point 8 of the GDPR that performs the tasks for NewsEchr (such as the incorporation of data base, technical support for realization of the purpose from Point 3 of this Privacy Notice etc.) or Recipient within the meaning of the Article 4 Paragraph 1 Point 9
    The above mentioned subjects have access and in other manner process the data only within the purpose described in Point 3 of this Privacy Notice, and are not authorized to process data in the manner that exceeds such purpose. The above mentioned subjects will be obliged to implement the data protection standards and requirements of GDPR. NewsEchr  will conclude the data processing agreements (DPA) in order to ensure the compliance with such requirements. The above mentioned subjects will be obliged to implement the encryption or pseudonymisation measures whenever it is technically feasible. For the sake of clarity, even in the case of transfer of the personal data to the above mentioned subjects, the NewsEchr as Data Controller should be responsible for the enabling of the adequate level of protection of the personal data.
  9. DATA SUBJECTS RIGHTS

    • The data subject pursuant to GDPR has to following rights:
    • Right of the data subject to access to the personal data processed by NewsEchr, right of the data subject to request the information from the NewsEchr  whether or not his/her personal data are being processed, and in what purpose. In the case of such request, NewsEchr is obliged to deliver the copy of the personal data which is processed in electronic form and free of charge (Article 15 of GDPR);
    • Right to rectification, right of the data subject to obtain the rectification of his/her inaccurate personal data without undue delay (Article 16 of GDPR);
    • Right to be forgotten, right of data subject to request the erasure of the personal data if certain conditions from the Article 17 of GDPR are met, i.e.;
    • Right to restriction of processing, right of the data subject to request the restriction of processing from, if specific conditions are met (Article 18 of GDPR);
    • Right on data portability, right of the data subject to receive his/her personal data, which he or she has provided to NewsEchr , in a structured, commonly used and machine-readable format, as well as the right to transmit those data to another controller (Article 19 of GDPR);
    • Right to object, right of the data subject to object at any time to the processing of his/her personal data. In case of objection, Controller shall no longer process the personal data unless the Controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims (Article 21 of GDPR);
    • Rights in relation to the automated individual decision-making, including profiling, pursuant to the Article 22 of GDPR;
    • Right to be informed in case of data breach pursuant to the conditions set in Article 34 of GDPR;
    • Right to address to the data protection authority.
  10. PROTECTION MEASURES

  11. NewsEchr  within its organization implements all the necessary organizational, technical and personnel measures in order to ensure the highest possible protection of the personal data, including but not limited to:
    • Technical measures of protection;
    • Control of the physical access to the system where the personal data are storage;
    • Control of the data transfer;
    • Control of the personal data entry;
    • Personal data access control;
    • Applicable information security measures;
    • All other measures necessary to ensure the adequate level of data protection.
    • For the sake of clarity the subjects from the Point 4 of this Privacy Notice are also obliged to implement the above mentioned measures.
    NewsEchr  hereby warrants to the data subjects the implementation of such measures by the subjects from the Point 4 of this Privacy Notice.
  12. STORAGE TIME

  13. NewsEchr  storage the personal data, as long as they are needed in order to fulfil the purpose from the Point 3 of this Privacy Notice, i.e. sending the Newsletter and other media content materials. If the data subject unilaterally terminate the agreement with NewsEchr  (i.e. it does not want to receive Newsletter and other media content materials anymore), it will send the notice pursuant to the Terms of Use of the NewsEchr  service that could be found on the following link: www.NewsEchr.com/terms. After the termination, the NewsEchr  will erase all the stored personal data of the data subject, as soon as possible but not later than 10 days from the day of the termination of the agreement.

This Privacy Notice enters into force on July 20, 2021.

    General Terms of Use

    Access to and use of this site (www.NewsEchr.com) is provided by NewsEchr subject to the following terms:
    1. By using www.NewsEchr.com you agree to be legally bound by these terms, which shall take effect immediately on your first use of www.NewsEchr.com. If you do not agree to be legally bound by the following terms in their entirety, you should not access and/or use www.NewsEchr.com.
    2. NewsEchr may amend these terms at any time by posting amendments online. Make sure you are aware of any amendments made by NewsEchr. Your continued use of www.NewsEchr.com after amendments are posted means you agree to be legally bound by these terms as updated and/or changed.
    3. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use www.NewsEchr.com content in any way except for your own personal, non-commercial use. You also undertake not to adapt, alter or create a derivative work from any www.NewsEchr.com content except for your own personal, non-commercial use. Any other use of www.NewsEchr.com content requires the prior written permission of NewsEchr.
    4. You agree to use www.NewsEchr.com only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of www.NewsEchr.com. Prohibited conduct includes but is not limited to intimidating or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within www.NewsEchr.com.
    5. Under no circumstances will NewsEchr be liable for any of the following losses or damage (whether such losses are foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of www.NewsEchr.com regardless of the form of action.
    6. NewsEchr does not warrant that functions contained in www.NewsEchr.com content will be uninterrupted or error free, that defects will be corrected, or that www.NewsEchr.com or the server that makes it available are free of viruses or bugs.
    7. The names, images and logos identifying NewsEchr and www.NewsEchr.com are subject to copyright, design rights and trade marks of NewsEchr. Nothing contained in these terms shall be construed as conferring by implication, or otherwise any licence or right to use any trademark, patent, design right or copyright of the NewsEchr.
    8.Where you are invited to submit any contribution to www.NewsEchr.com (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant NewsEchr a perpetual, royalty-free, non-exclusive, sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution. If you do not want to grant to NewsEchr the rights set out above, you should not submit your contribution to www.NewsEchr.com.
    1. By submitting your contribution to www.NewsEchr.com you guarantee that your contribution is your own original work and that you have the right to make it available to the NewsEchr for all the purposes specified above; is not defamatory; and does not infringe any law; and indemnify NewsEchr against all legal fees, damages and other expenses that may be incurred by NewsEchr as a result of your breach of the above warranty; and waive any copyright in your contribution for the purposes of its submission to and publication on www.NewsEchr.com and the purposes specified above.
    2. You agree to use www.NewsEchr.com in accordance with the following rules.
    3. a) Contributions must be civil and tasteful. Offensive, abusive, unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable. No spamming or off-topic material: we don’t allow the submission of the same or very similar contributions many times. Please don’t re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas. Material which, in the sole opinion of NewsEchr is in breach of these standards will not be published.
    4. b) No advertising. No impersonation. No inappropriate (e.g. vulgar, offensive etc) user names.
    5. c) About the law: You may not submit any defamatory or illegal material of any nature in www.NewsEchr.com. This includes text, graphics, video, programs or audio. Contributing material with the intention of committing or promoting an illegal act is strictly prohibited. You agree to only submit materials which are your own original work. You must not violate, plagiarise, or infringe the rights of third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights. The views expressed in www.NewsEchr.com comment areas are those of members of the public and are not necessarily those of NewsEchr.
    6. d) NewsEchr reserves the right to delete any contribution at any time, for any reason. If in the sole opinion of NewsEchr you breach any of these Terms of Use, your contribution will not be published and your subscription(if any) may be cancelled without right to any recompense for any unused time.

    Changes to these Terms of Use

    These terms of use are effective July 21st 2021. From time to time we may make changes to the Terms of Use to reflect any changes to our activities in accordance with changes to legislation, best practice or website enhancements.
